David Malamatenios

Partner in the Employment Department

David qualified as a solicitor in 1992. He quickly developed an interest in employment law and has specialised in this field since 1995. David acts primarily for companies but he also represents senior executives seeking to negotiate enhanced severance packages.

David has developed a strong practice in contentious employment work and is experienced in all aspects of employment litigation in the Employment Tribunals and higher Courts. He regularly appears as an advocate in the Employment Tribunal. David advises clients on all stages of the Tribunal Procedure and conducts a large Tribunal caseload. He acts on behalf of a number of large companies and PLC's in the Employment Tribunal where he deals with such issues as unfair dismissal, discrimination, whistle-blowing, TUPE and breach of contract.

As well as his Tribunal work, David is very knowledgeable on all aspects of non-contentious employment law. He regularly drafts contracts and employment policies. David works closely with the HR departments of several PLC's and large companies in the construction and banking fields, advising HR directors and their colleagues on policy issues, TUPE, and providing practical and legal guidance on all HR and disciplinary/capability issues. He has particular experience assisting companies on redundancy issues and has advised on a number of large collective redundancies in the construction sector. David has also dealt with internationally based clients, particularly in the US and Saudi Arabia and has acted on a number of high profile international claims.

David often speaks on employment issues and frequently writes on employment issues for the professional HR press.

He is a member of the Employment Law Association (ELA).
