Employers

We advise and provide support on a wide range of employment law issues for employers. Our clients include large corporate organisations, especially in the Construction sector, accountancy firms, banks and insurance companies.

The advise that we provide falls under the following four categories:

1. Advice and support to HR professionals

The pressures under which HR managers have to work are intense. Each month brings new case law, legislation, regulations and procedures which you have to keep up-to-date with. Our aim is to help you navigate through the employment law maze, ensuring your business always remains fully protected. We advise on:

  • employee disputes
  • disciplinary and grievance procedures
  • discrimination (age, sex, race, disability, sexual orientation and religion or belief)
  • dismissals and compromise agreements
  • contracts of employment/service agreements
  • breach of contract
  • injunctions
  • policies and procedures
  • day-to-day advice on sick leave, maternity, paternity and parental rights and flexible working
  • advising on the movement of teams of employees, including the enforceability of restrictive covenants
  • outsourcing
  • transfers of employment and the application of TUPE
  • employment aspects of share and asset sales
  • advising on the reorganisation of businesses

2. Tribunal and Court representation

In recent years the volume of claims has increased dramatically, we as experienced Tribunal representatives can act quickly to ensure that your best position is put forward. We will give you realistic, practical advice on the claim and will make a commercial settlement if this is in your best interest.

3. Drafting Contracts, Policies and Handbooks

We can draft policies and procedures for your business, such as disciplinary and grievance procedures, internet usage policies and equal opportunity statements. We also advise on related issues such as dealing with stress in the work place, health and safety obligations and policy implementation or changes. We ensure that the documents we prepare for your business reflect current statutory requirements and best practice.

4. TUPE
(I) Employment issues arising from the sale or purchase of a business

If you wish to purchase or sell a business then there will be complex issues regarding the employees, which are an integral part of your business.

If you are purchasing you will need a solicitor to advise you on the employment law and contractual liabilities which go with your business. If you are selling, you will need a solicitor to deal with the purchaser's inquiries and to guide you through the necessary procedures. We have the experience in dealing with these issues, providing rapid, practical and cost effective advice.

(II) Service Provisions

TUPE does not just apply when buying or selling a business. Organisations should also be aware of the Type B service provision change transfer. This is designed to cover contracting out scenarios, with the intention of ensuring TUPE will comprehensively apply.

If you contract out any services such as cleaning contracts, administrative staff etc you may come under the TUPE regulation when changing contractors or bringing work back in-house. Our specialists have the necessary experience in this complex field of Employment Law to advise you whether or not the regulation applies and then how best to proceed.
